1. About CoastNex
CoastNex is a cloud communications platform for cross-border marketing SMS campaigns and global application-to-person (A2P) SMS route operations, operated by COASTLINECOUTURE LLC ("CoastNex," "we," "us," or "our"). The platform provides wholesale A2P routes, one-time password and verification delivery, sender ID management, delivery receipt (DLR) analytics, and connectivity via SMPP and REST API. By creating an account or using the services, you agree to these Terms of Service.
2. Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to register for an account. You must provide an accurate email address, phone number, and other registration details, and keep them current. You are responsible for safeguarding your password, API credentials, and all activity that occurs under your account, and must notify us promptly of any unauthorized access.
3. Acceptable use and anti-spam policy
You may only send marketing SMS through CoastNex to recipients who have given clear, documented consent to receive messages from you, and you must honor opt-out and STOP requests without delay. You are responsible for maintaining evidence of consent and for complying with applicable telecommunications, anti-spam, and consumer protection laws in every destination you message.
The following content and traffic are prohibited on the platform:
- Messages sent without verifiable recipient consent.
- Phishing, malware links, fraud, or deceptive sender identity.
- Content that is unlawful, harassing, hateful, or infringes the rights of others.
- Illegal gambling, unlicensed pharmaceuticals, or narcotics.
- Traffic that misrepresents its origin or attempts to evade carrier or regulatory filtering.
We may filter, throttle, suspend, or block traffic that violates this policy, threatens network integrity, or exposes carriers, recipients, or CoastNex to legal or reputational risk.
4. Service levels
Route availability, throughput, sender ID options, and delivery performance vary by destination, carrier, and the commercial plan associated with your account. We work to maintain reliable routing and accurate DLR reporting, but delivery of any individual message is not guaranteed, as it depends on factors outside our control, including carrier networks and recipient device availability.
5. Fees
Paid usage is billed according to the pricing, currency, and billing cycle shown in your account or order form, including per-message and route-specific rates. Fees are payable in advance or on the billing cycle stated at signup, and, unless otherwise agreed in writing, are non-refundable once messages have been submitted for delivery.
6. Liability
To the maximum extent permitted by law, the services are provided on an "as available" basis without warranties of any kind. Neither party is liable for indirect, incidental, special, or consequential damages arising from use of the platform. Our aggregate liability for any claim relating to the services is limited to the fees you paid to CoastNex in the three months preceding the claim.
7. Termination
You may close your account at any time, subject to outstanding fees. We may suspend or terminate your access for breach of these terms, unlawful or abusive traffic, non-payment, or conduct that threatens the platform, other users, or message recipients. Provisions that by their nature should survive termination, including payment obligations and liability limits, will continue to apply.
8. Governing law
These terms are governed by the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles. Any dispute arising from these terms or the services will be subject to the exclusive jurisdiction of the courts located in Delaware, United States of America.
